Welcome to PushFeedback, a service provided by Volcanic Labs SLU. These terms and conditions ("Terms") govern your use of our website, products, and services (collectively referred to as the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Intellectual property

All content and materials provided by PushFeedback, excluding user-generated content, are protected by intellectual property laws. Feedback you provide about the PushFeedback service may be used by us without obligation and remains the intellectual property of PushFeedback. End-user feedback collected through the widget remains your exclusive property.

2. Use of services

You agree to use our Services in compliance with applicable laws and these Terms. Any activity conducted through your account is your responsibility. Unauthorized or illegal use may result in account suspension or termination.

3. Privacy and data protection

Our Privacy Policy governs collection, use, and disclosure of personal information. By using our Services, you consent to these practices. Additionally, your use of the Services is subject to our Data Processing Agreement (DPA), which outlines GDPR-compliant processing practices.

4. Service availability and SLA

Our Services are provided on a commercially reasonable basis. For standard users, we do not guarantee uninterrupted service. For enterprise customers, service levels, uptime commitments, and support response times are specified in a Service Level Agreement (SLA), available upon request.

5. Confidential information

"Confidential Information" means information disclosed by one party to the other that is marked confidential or should reasonably be understood as such. Your Confidential Information includes your Inputs and Outputs; our Confidential Information includes non-public technology and pricing.

The receiving party will protect confidential information with at least reasonable care and will not disclose or use it outside the scope of these Terms.

Exclusions include publicly available information, information lawfully received from third parties, or independently developed information. Compelled disclosures required by law are permitted with prior notice where legally allowed. Upon termination, each party will return or destroy confidential information.

6. Payments, cancellations, and refunds

Pricing and plans are available at https://pushfeedback.com#pricing. First-time subscriptions include a free trial. Monthly subscription cancellations prevent further charges but do not refund the current month. Annual subscriptions canceled within 30 days of renewal are fully refunded; cancellations after 30 days retain service for the remainder of the subscription year.

7. Feedback interactions and data responsibility

You are responsible for handling all interactions through the PushFeedback widget in compliance with applicable privacy laws. PushFeedback is not liable for any misuse of user data collected through your implementation of the widget. Enterprise customers may request contractual assurances regarding GDPR compliance and data handling.

8. Open-source license

PushFeedback may provide a complimentary Starter license for eligible open-source projects. Use of this license is subject to the conditions outlined on our website, including logo display, open-source requirements, and promotional permissions. PushFeedback reserves the right to review eligibility and modify or revoke the license with notice.

9. Use of logos and branding

By using our Services, you grant PushFeedback permission to use your logo and branding in promotional materials, unless you opt out by emailing info@techdocs.studio. Opt-out requests are honored promptly.

10. Termination and account suspension

Either party may terminate by providing written notice. Termination does not relieve obligations incurred prior to termination. PushFeedback may suspend or terminate accounts for violations, illegal activity, non-payment, or security risks. Notification will be provided via account email where feasible.

11. Limitation of liability

To the maximum extent permitted by law, PushFeedback and affiliates disclaim all liabilities arising from the use of our Services. Total liability is limited to fees paid in the 12 months preceding any claim, except as required by applicable law. Enterprise customers may negotiate additional liability terms in a separate agreement.

12. Governing law and jurisdiction

These Terms are governed by the laws of Spain. Disputes will be subject to the exclusive jurisdiction of the courts in Santa Cruz de Tenerife, Spain.

13. Modifications to terms

PushFeedback may modify these Terms occasionally. Continued use constitutes acceptance of revised Terms.

14. Force majeure

Neither party is liable for delays or failures due to circumstances beyond reasonable control, including acts of God, war, terrorism, or government actions. Parties will use reasonable efforts to notify the other promptly of such events.
