Terms of Service

These Terms of Service (the “Terms”) govern access to PushFeedback’s website, widget, dashboard, API, and related services (collectively, the “Services”). The Services are provided by Volcanic Labs SLU, trading as PushFeedback (“PushFeedback”, “we”, “us”). By creating an account, ordering a plan, or using the Services, the person or entity doing so (“Customer”, “you”) agrees to these Terms. If you use the Services for an organisation, you confirm that you can bind that organisation.
1. Accounts and permitted use
Customer may use the Services during a subscription term for its internal business purposes and in accordance with the documentation, plan limits, and applicable law. Customer is responsible for its account credentials, authorised users, Customer Content, and use of the widget on its sites or applications. Customer must not interfere with the Services, bypass plan limits or security controls, reverse engineer the Services except where law prohibits that restriction, or use the Services unlawfully.
2. Customer Content and feedback
“Customer Content” means content Customer or its end users submit to, store in, or make available through the Services, including feedback messages, screenshots, contact details, page URLs, and metadata. Customer retains its rights in Customer Content and grants PushFeedback the limited right to host, process, transmit, display, and otherwise use it as necessary to provide, secure, and support the Services and as described in these Terms and the Data Processing Agreement. Customer represents that it has all rights, notices, permissions, and lawful bases needed for its use of the Services and Customer Content.
3. Our intellectual property
PushFeedback and its licensors retain all rights in the Services, documentation, software, designs, and other materials we provide. We may use suggestions or feedback about the Services without restriction or compensation. No rights are granted except those expressly stated in these Terms.
4. Privacy and data protection
Our Privacy Policy explains how we process personal data as a controller for our website, accounts, billing, and communications. Where PushFeedback processes personal data in Customer Content on Customer’s behalf, the Data Processing Agreement applies and forms part of these Terms. Customer remains responsible for deciding the purposes and means of that processing and for providing required notices to its end users.
5. Plans, fees, and taxes
Current plans, included limits, and prices are shown at pushfeedback.com/pricing or in an order form. Fees are due in advance, non-refundable except where these Terms, an order form, or applicable law says otherwise, and exclude taxes, levies, or duties. Customer is responsible for applicable taxes other than taxes on PushFeedback’s income. We may suspend access for overdue undisputed amounts after reasonable notice.
6. Trials, renewal, and cancellation
A free trial is available only to first-time subscriptions unless we state otherwise. Paid subscriptions renew automatically for successive terms matching the initial billing period unless Customer cancels before renewal through the account or another stated method. Monthly cancellations stop future renewals but do not refund the current month. Annual subscriptions cancelled within 15 days after an annual renewal are refunded in full; after that, service continues through the paid term. We may change prices for a renewal by posting the change before that renewal.
7. Service changes and availability
We may update the Services, including features, integrations, and technical components, provided we do not materially reduce the core functionality of a paid plan during its current paid term. The Services are provided on a commercially reasonable basis and may be unavailable from time to time. Any service levels or support commitments apply only if expressly agreed in writing.
8. AI features
Optional AI Reports analyse selected feedback when an authorised Customer user requests them. AI-generated output may be inaccurate, incomplete, or unsuitable for a particular purpose and must be reviewed by Customer before use. Customer can disable AI Reports in team settings. Use of these features may involve the providers described in our security documentation.
9. Confidentiality
“Confidential Information” means non-public information disclosed by one party to the other that is marked confidential or should reasonably be understood as confidential. The receiving party will use it only to perform under these Terms and protect it with at least reasonable care. Confidential Information does not include information that is public without breach, lawfully received from a third party, independently developed, or required to be disclosed by law, provided notice is given where legally permitted.
10. Publicity
During the subscription, Customer grants PushFeedback a non-exclusive, worldwide, royalty-free right to identify Customer as a PushFeedback customer and display Customer’s name and logo in customer lists and marketing materials. To the extent permitted by the relevant platform terms and third-party rights, PushFeedback may reproduce public testimonials, reviews, or quotations attributable to Customer or its authorised representatives and create case studies from public information. We will not disclose Customer Confidential Information or materially alter a quotation. Customer may opt out of future use by contacting [email protected].
11. Suspension and termination
Either party may terminate these Terms for a material breach that is not cured within 30 days after written notice. PushFeedback may suspend or terminate access immediately where necessary to address a security risk, unlawful use, non-payment, infringement, or a serious or non-curable breach. Termination does not affect accrued payment obligations. On termination, Customer’s access ends and the DPA governs Customer Content deletion or return.
12. Warranties and disclaimers
PushFeedback warrants that it will provide the Services using reasonable skill and care. Except for that express warranty and to the maximum extent permitted by law, the Services are provided “as is” and “as available”; we disclaim all implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
13. Limitation of liability
To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, goodwill, or data. Each party’s total liability arising out of or relating to the Services will not exceed the fees paid by Customer to PushFeedback for the affected Services during the 12 months preceding the event giving rise to the claim. These limits do not apply where they cannot lawfully apply.
14. Customer indemnity
Customer will defend and indemnify PushFeedback and its affiliates, officers, directors, employees, and agents against third-party claims and related losses, damages, and reasonable legal fees arising from Customer Content, Customer’s implementation or use of the widget, or Customer’s breach of Sections 1, 2, or 4. This obligation applies only if PushFeedback promptly gives Customer written notice of the claim, allows Customer to control the defence and settlement, and reasonably cooperates at Customer’s expense. Customer may not settle a claim in a way that admits liability or imposes obligations on PushFeedback without our written consent.
15. Changes to these Terms
We may update these Terms by posting the revised version on this page. The updated Terms apply from the stated effective date and continued use after that date constitutes acceptance. Where applicable law requires separate or advance notice, we will provide it.
16. General
Neither party is liable for a delay or failure caused by circumstances beyond its reasonable control. These Terms are governed by Spanish law, and the courts of Santa Cruz de Tenerife, Spain have exclusive jurisdiction, except where mandatory law provides otherwise. Neither party may assign these Terms without the other party’s consent, except PushFeedback may assign them to an affiliate or in connection with a financing, merger, reorganisation, acquisition, or sale of all or substantially all of its business or assets. These Terms, the Privacy Policy, DPA, and any order form are the entire agreement about the Services and supersede prior agreements on that subject. If a provision is unenforceable, the rest remains in effect. No waiver is effective unless in writing.
